SUMMARY:Mpumalanga Stakeholder  Engagement  Breakfast
DESCRIPTION:The Information Regulator (Regulator) invites organised professional bodies and public bodies to a Stakeholder Engagement Breakfast to discuss the Protection of Personal Information Act 4 of 2013 (POPIA) and the Promotion of Access to Information Act 2 of 2000 (PAIA). The Regulator will unpack the importance of compliance with POPIA and PAIA and the role that can be played by professionals\, civil society organisations\, business and public institutions in promotion of the right to privacy as it relates to the protection of personal information\, and the right of access to information. It is the responsibility of the Regulator to educate and consult with stakeholders on the implementation of these two laws. The engagement will give opportunity to the stakeholders to engage with the Regulator on the matters they are grappling with in relation to the implementation of\, and compliance with these two pieces of legislation. \nPlease also note that in celebration of the Mandela Day which is celebrated globally on 18 July\, the Regulator has also planned a series of events that will culminate the main event which is the public engagement scheduled for 20 July 2023 in Ehlanzeni District Municipality. \nPlease extend the invitation to other professional body structures for their participation. SUMMARY:Consultative Session with Stakeholders on the Development of the Direct Marketing Guidance Note
DESCRIPTION:The Regulator has noted a significant increase in the number of complaints lodged regarding the processing of personal information through direct marketing by means of unsolicited electronic communications. This necessitated the need to consult with interested parties in order to develop and issue a Guidance Note on direct marketing in light of the proposal by the Direct Marketing Association of South Africa (DMSA). \nThis consultation aligns with one of the functions of the Regulator\, which is to consult with interested parties\, receive\, and invite representations from the public on any matter affecting the personal information of a data subject\, as per section 40(1)(c)(i) of POPIA. \nRecognising the importance of engaging and consulting with stakeholders in the consumer and direct marketing industry\, the Regulator deems it necessary to invite all stakeholders\, organised structures\, and data privacy experts interested in direct marketing to join us for a consultative session. DESCRIPTION:About the event\nThe Information Regulator (Regulator) will on Wednesday\, 5 April 2023\, hold a press briefing to share with members of the media and public\, the outcomes of some of the high-profile cases\, on which it has been conducting investigations. These cases relate to both the Promotion of Access to Information Act (PAIA) and Protection of Personal Information Act (POPIA) complaints received and own-initiative assessments. \nThe briefing will cover some matters relating to resolution of various PAIA complaints received. These include a matter related to regarding access to records from the South African Police Service (SAPS)\, industry royalties involving the South African Music Rights Organisation (SAMRO)\, a matter regarding mining status reports from the Department of Mineral Resources and Energy (DMRE)\, and access to patients’ health records from the Eastern Cape Department of Health.
